PLEASE READ THESE TERMS CAREFULLY. By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, without limitation or qualification. If you do not agree, do not access or use the Site.


1. Eligibility and Acceptance

The Site and Service are intended solely for business owners, authorized representatives, and guarantors who are at least 18 years old, located in the United States, and seeking to apply for commercial financing for a legitimate business purpose. By using the Site, you represent that you meet these requirements and that all information you submit is accurate and complete.

You agree not to access the Site from, or on behalf of any entity located in, any country or region subject to sanctions administered by the U.S. Office of Foreign Assets Control (OFAC). We reserve the right to restrict or terminate access from any such location.


2. Nature of Our Service

Concord Capital is a direct lender offering commercial financing products to qualifying businesses. Use of the Site, including submitting an application, does not guarantee approval, and does not itself constitute a loan offer, commitment, or agreement. Any financing is subject to underwriting, verification, and execution of separate loan documents, which will set out the specific rates, fees, repayment terms, and conditions applicable to your financing. In the event of any conflict between this Site and your executed loan agreement, the loan agreement controls.


Products, rates, fees, and eligibility requirements may vary by state and are subject to change without notice. Not all products are available in all states.


3. Authorized Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely to review our products and submit a financing application. You agree not to:

  • Reproduce, duplicate, copy, sell, resell, scrape, or exploit any part of the Site for commercial purposes;
  • Use any automated system (bots, spiders, scrapers) to access the Site without our prior written consent;
  • Interfere with or disrupt the Site's servers or networks; or
  • Attempt to gain unauthorized access to any portion of the Site or any systems connected to it.


4. Application Information and Credit Authorization

By submitting an application, you authorize Concord Capital and its service providers to verify the information provided, including by obtaining consumer and/or business credit reports, bank account and transaction data, and other information relevant to underwriting, from credit bureaus, banking data aggregators, and other third-party sources. You represent that you have the authority to provide this information and to authorize such inquiries, including on behalf of any business entity and any guarantors identified in your application.


5. Electronic Communications and Signatures

By using the Site and submitting an application, you consent to receive communications from us electronically, including disclosures, notices, agreements, and account information, and you agree that any electronic signature you provide has the same legal effect as a handwritten signature, consistent with the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law (e.g., the Uniform Electronic Transactions Act). You may withdraw this consent at any time by contacting us, though doing so may affect our ability to process your application.


6. Telephone and Text Communications Consent

By providing a telephone number, you consent to be contacted by Concord Capital, its affiliates, and service providers at that number — including by call, text message, or automated/prerecorded means — regarding your application, account, or related offers, even if your number is on a state or national do-not-call registry. Consent to receive such communications is not a condition of obtaining financing. Message and data rates may apply. You may opt out of marketing texts or calls at any time using the instructions provided in those communications or by contacting us directly. This section is provided consistent with the Telephone Consumer Protection Act (TCPA) and comparable state laws.


7. State Licensing and Commercial Financing Disclosures

Concord Capital maintains lending licenses in the states where such licensing is required for our products, and where it is not otherwise exempt, and complies with applicable state usury, disclosure, and commercial financing laws. Several states — including California, New York, Utah, Virginia, Florida, Georgia, and Missouri, among others as their laws take effect — require lenders to provide specific disclosures for commercial financing (such as estimated annual percentage rate, total repayment amount, and payment schedule) prior to consummation. Where applicable, we will provide these disclosures directly in your financing offer or loan agreement, separate from this Site.


Nothing on this Site is intended to offer financing in any state where we are not licensed or exempt from licensure to do so.


8. Intellectual Property

All text, graphics, logos, images, and other content on the Site ("Content") are the property of Concord Capital or its licensors and are protected under U.S. copyright, trademark, and other intellectual property laws. Except as expressly authorized in these Terms, you may not copy, modify, distribute, display, or create derivative works from any Content without our prior written permission. All Concord Capital names, logos, and marks are trademarks of Concord Capital; nothing in these Terms grants you any license or right to use them.


9. User Submissions

Any information, feedback, testimonials, or other content you submit to the Site (other than application data governed by our Privacy Policy) is considered non-confidential and non-proprietary. You grant Concord Capital a perpetual, royalty-free, worldwide right to use, reproduce, and display such submissions for any business purpose. You agree not to submit any content that is unlawful, defamatory, obscene, or infringing on the rights of others.


10. Website Content; No Warranty

The Content on the Site is provided for general informational purposes only. While we use reasonable efforts to keep information accurate and current, we make no warranties or representations regarding the accuracy, completeness, or reliability of any Content, and rates, terms, and product availability are subject to change without notice.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CONCORD CAPITAL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE — REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, WARRANTY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS ON LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.


12. Indemnification

You agree to indemnify, defend, and hold harmless Concord Capital and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any applicable law or third-party right.


13. Third-Party Links and Advertisers

The Site may contain links to third-party websites or feature third-party advertisers. We do not control and are not responsible for the content, privacy practices, or business practices of any third party. Any dealings you have with third-party advertisers or linked sites are solely between you and that party, and we are not liable for any resulting loss or damage.


14. Site Availability

Access to the Site may be interrupted or delayed due to factors including hardware or software failure, network issues, maintenance, security incidents, or events beyond our reasonable control (including natural disasters, acts of government, or force majeure events). We are not liable for any such disruption.


15. Dispute Resolution; Arbitration Agreement

Please read this section carefully — it affects your legal rights.

Except where prohibited by applicable law, you and Concord Capital agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any financing application (excluding disputes arising under a separately executed loan agreement, which will be governed by the dispute resolution provisions of that agreement) shall be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court.


Class Action Waiver. You and Concord Capital agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, collective, or representative action, to the fullest extent permitted by law.


Opt-Out. You may opt out of this arbitration agreement by sending written notice to us at the contact information below within 30 days of first accepting these Terms.


This arbitration agreement is governed by the Federal Arbitration Act. If any part of this section is found unenforceable, the remainder shall remain in effect, except that if the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court.


16. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent preempted by federal law or where mandatory consumer or commercial-financing protections of your home state apply. For any dispute not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Suffolk County, New York.


17. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.


18. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.


19. Termination

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
